Agreement Between School and Search Associates

PLEASE READ CAREFULLY. THIS AGREEMENT AND THE ENTIRE APPLICATION FORM MUST BE COMPLETED PERSONALLY BY THE SCHOOL HEAD OR REVIEWED IN DETAIL AND APPROVED PERSONALLY BY THE SCHOOL HEAD, AS THEY CONTAIN INFORMATION WHICH HAS LEGAL AND CONTRACTUAL SIGNIFICANCE.
The Terms Of Agreement that appear below are for guidance only. They are taken from the application form that all schools must complete in order to register with Search Associates. In the case of any disagreement between what is written below and the Terms Of Agreement that appear in the application form on www.search-associates.com, the terms of the agreement in the application form which you must complete and sign to register with Search Associates prevail. |
Registering with Search Associates allows recruiters to search the Search Associates candidate database for suitable candidates and it also allows the candidates to search for suitable positions in the Search Associates schools database where each registered school lists information about itself, its vacancies and its hiring policies. All details of each candidate visit and recruiter visit are recorded and automatically sent to the appropriate associate electronically, so that we are able to keep permanent records of all search activity on our site.
In order to attend a Search Associates recruitment fair or to gain access to our web databases, all recruiters must agree to the following:
TERMS OF AGREEMENT
- Should a recruiter visit the web application of any candidate on the Search Associates website, and should the school subsequently hire that candidate, the school agrees to pay in full the appropriate placement fee, as published on this website and revised from time to time. Should a candidate visit your school vacancy page on the Search Associates website, and subsequently contact your school and be hired, the school will abide by all the terms of the payment agreement outlined in this paragraph.
- If a recruiter interviews a candidate at more than one recruiting fair, the recruiter and school agree to pay the fee to the organization which sponsored the fair at which the candidate was first interviewed.
- The recruiter and school agree to notify promptly the appropriate Associate (name and address as indicated at the top of page 1 of the candidate's application) of any verbal or written offer accepted verbally or in writing by the candidate, preferably no later than 10 days after such offer is accepted by the candidate.
- The recruiter and school agree that all placement fees will be paid promptly, and in any case no later than 15 days after receipt of an invoice.
- The recruiter and school agree that the school will pay the standard fee for any candidate who is NOT hired at the same time his/her partner is hired, but who is subsequently hired by the school within 13 months of the reporting/starting date of the partner originally employed.
- The recruiter and school agree to give all candidates sufficient time to consider a verbal or written offer of employment, and to refrain from exerting undue pressure such as requiring a decision in an unreasonably short period of time.
- The recruiters and school agree to guard the confidentiality of all information and materials in the password-protected sections of our website and our web databases. This applies ESPECIALLY to any confidential references, whether on paper (received by mail, fax or at a recruitment fair, or printed by the recruiter from Search's databases) or on screen. Only an authorised recruiter, viewing only references of candidates under consideration by his or her school, should ever call up on screen any confidential reference.
- The recruiters and school agree that they will NOT give to other recruiters or organizations any of our web information, passwords, or hard copies of information about Search Associates candidates and will not in any way refer Search Associates candidates to other schools without permission from Search Associates.
- The recruiter and school agree to give the school username and password to at least two other long term employees of the school (whose names they will submit to Search Associates when completing the Search Associates school registration application form), and acknowledge that loss of either username or password may necessitate completing the school application form all over again.
- The recruiter and school agree to update the vacancy list promptly when a new position is available or when a position is filled. The recruiter and school acknowledge that if a vacancy posted on our website is left unattended for 45 days, it is automatically deleted. (Please note that the web automatically generates a reminder every 15 days for each vacancy which you list.)
- Search Associates does everything possible to prevent teachers from reneging on or resigning early from a contract, including a requirement that they sign an agreement in which they promise to reimburse the school the Search Associates placement fee if they do so. The school and recruiter agree that they will hold the teacher responsible for this fee and will accept responsibility for collecting it (prior to the departure of the candidate) in the event that the candidate begins teaching at the school and then decides to resign prior to the end of contract.
- The recruiter and school agree to abide by the joint Code of Ethics, which was published and distributed in October of 2001 by the major recruiting associations.
- Search Associates reserves the right to cancel a school's password and access to the password-protected section of the website at any time, should any breach of ethics be committed by the school (as indicated above or in the school's treatment of teachers in the school).
- The recruiter and school agree that all pages in Parts 1 through 4 of the Search Associates school registration application form will be printed and kept as a permanent record by the school.
The term 'recruiter' is used in this Agreement to denote the person authorised by the school to complete the Search Associates school registration application form and sign this agreement on behalf of the school - ideally the Head of the school or similar senior member of staff charged with the recruitment of teaching staff for the school.
The Agreement between the school and Search Associates will become binding when:
- Search Associates has received a signed hard copy of the school's entire application, including the Terms of Agreement, by post mailed to:

- Search Associates notifies the school that their application has been accepted and their chosen username and password have been enabled.
